the perspective purchaser of the of the horse or the perspective purchaser’s agent. The buyer
acknowledges that Mt. Baker Veterinary and its veterinarians shall perform the pre-purchase
examination at the request of the buyer on the horse named __________________________ upon the
terms and conditions of this agreement, which includes the promise by the buyer not to sue, based
upon buyer dissatisfaction with the executed purchase of the animal that has been examined and
identified in this agreement. A pre-purchase examination of the horse named
_________________________ will be performed by Mt. Baker Veterinary on or about
____________________(date).
Mt. Baker Veterinary and its veterinarians will assist the buyer in determining the scope of the
examination as well as any additional diagnostic testing that will be performed, based upon the level of
thoroughness desired by the buyer, the buyer’s budget, knowledge of any preexisting medical
conditions and any findings of the pre-purchase exam which would indicate further diagnostic testing
should be pursued. The veterinarian conducting the pre-purchase examination will provide the buyer
with information regarding any known existing medical problems, as well as the horse’s overall health
and condition at that particular time, based on the examination and diagnostics performed. The
veterinarian’s ability to perform the pre-purchase exam is also partly dependent on the seller’s good
faith provision of information, records and statements regarding the horse’s medical history. There are
many diseases and or conditions which, in their early stages, are not clinically apparent. Therefore, it is
entirely possible that the horse maybe in the early stages of one or more such conditions on the day of
the exam, however, will show no signs of the condition and therefore will not be elucidated by the pre-purchase exam. The pre-purchase examination cannot be and is not intended to be used as a prognostic indicator of future soundness or health of the horse. There is no warranty made either explicitly or implied as to the horse’s future suitability for any particular use, and there will be no pass or fail
determination made. The decision of whether or not to purchase the horse rests solely upon the buyer.
The buyer hereby recognizes and acknowledges that a material condition of Mt. Baker Veterinary’s
agreement to perform this pre-purchase examination is the buyer’s agreement to release, waive and
discharge Mt. Baker Veterinary, its veterinarians and employees from all claims arising directly or indirectly from the performance of the pre-purchase examination; this is a promise not to sue.
I have read this agreement and fully understand its terms. My signature here indicates my complete
and unconditional liability release to Mt. Baker Veterinary.
